Launch Giveaway Official Rules

1. Sponsor

The LanguageEverest Launch Giveaway is sponsored by Nico Kalkusinski (operating as 'LanguageEverest'), based in Bielsko-Biala, Poland.

2. Eligibility

• Open only to legal residents of the United States (excluding New York, Florida, and Rhode Island), Canada (excluding Quebec), and the European Union member states, and the United Kingdom.
• Entrants must be 18 years of age or older at the time of entry.
• Immediate family members of the Sponsor (spouse, parents, siblings, and children) may enter and refer friends, but are not eligible to receive a prize themselves if selected.
• Entrants certify that they meet these eligibility requirements when entering.
• Winners may be required to provide proof of age and residency (such as government-issued ID or address verification) before a prize is awarded.
• The Giveaway is void where prohibited or restricted by law.

3. Giveaway Period

The Giveaway begins on 1 November 2025 and will conclude no later than 31 January 2026, or earlier at the Sponsor's discretion once the product launch is complete. The actual end date will be announced on the Sponsor's official Instagram and Threads accounts (@nicokalkusinski) no later than 1 January 2026. All entries must be received by the posted end date to be eligible.

4. How to Enter

• To enter, visit languageeverest.com/waitlist, join the waitlist, and confirm your email address.
• Limit one (1) entry per person. Multiple entries by the same person using different emails are not permitted and will be disqualified.
• No purchase necessary.

5. Referral Bonus

• Entrants will receive a unique referral link.
• If a referred friend joins the Giveaway using that link, confirms their entry, and is selected as a winner, both the friend (entrant) and the referrer will receive the prize.
• Referrers do not receive additional entries in the drawing; however, each referred entrant represents another chance for the referrer to win if that entrant is chosen.
• For recognition purposes, entrants may see a partially masked version of the referrer's email address (e.g., j***@example.com) when joining via a referral link.

6. Prize

• Each winner will receive one (1) year of Pro subscription access to LanguageEverest.
• Approximate Retail Value (ARV): 79.50 EUR per prize.
• Total number of prizes available: 3.
• If a winner entered via a referral link, both the winner and the referrer will receive the prize. This counts as one prize allocation, not two separate prizes.
• Prize is non-transferable and not redeemable for cash.
• The Sponsor reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable.

7. Winner Selection & Odds

• A total of three (3) winners will be selected in a random drawing from all eligible entries received by the entry deadline.
• Odds of winning depend on the total number of eligible entries received.
• Referrals do not create additional entries for the referrer, but they increase a participant's effective chances of winning because if a referred friend is selected as one of the winners, the referrer also wins the same prize. This shared outcome counts as one prize allocation.
• Winners will be notified via the email address provided within 7 days of the drawing. The Sponsor will make up to three (3) attempts to contact each winner within a 14-day period beginning on the date of the first notification email. If a winner does not respond within 14 days of the first notification, that winner forfeits the prize and an alternate winner may be selected.
• Canadian residents may be required to correctly answer a skill-testing question before being confirmed as winners, as required by law.

8. Publicity

By entering, entrants grant Sponsor the right to use their name, likeness, and entry for promotional purposes in any media, worldwide, without further compensation, unless prohibited by law.

9. General Conditions

• Sponsor reserves the right to cancel, suspend, or modify the Giveaway if fraud, technical failures, or any other factor impairs the integrity of the Giveaway.
• Sponsor is not responsible for technical issues, lost entries, or incorrect contact information provided by entrants.
• Any attempt to deliberately undermine the Giveaway may result in disqualification.

10. Privacy

• Personal data collected in connection with this Giveaway will be used only for the administration of the Giveaway, early access opportunities, and related communications, unless the entrant has separately consented to receive marketing communications.
• Sponsor will not sell or share entrant data with third parties.
• For transparency, referral landing pages may display a masked version of the referrer's email address to confirm who invited the entrant. Full email addresses are never shared publicly.

11. Governing Law

This Giveaway is governed by the laws of Poland, without regard to conflict of law principles. All disputes will be resolved exclusively in the courts located in Poland, without prejudice to any mandatory rights under applicable local laws of the entrant's country of residence.

12. Participant Communications

By entering, participants agree that the Sponsor may contact them for purposes of administering the Giveaway, including entry confirmation, winner notification, and related announcements. As part of the Giveaway, the Sponsor may also send a one-time discount offer to all entrants following the conclusion of the Giveaway. This discount will be valid for 24 hours from the time the email is sent. Entrants who separately consent to receive marketing communications may receive additional emails as described in the Privacy section. Entrants may unsubscribe from giveaway-related communications at any time, but doing so may result in forfeiture of eligibility if communication is required for prize notification.
